Know Your Nikkah Nama [A Public Service Message]

The requirement of Basic Information 

Section 1 to 5 is as important as it asks the basic information about the groom and bride. Name, Parentage, Residence etc. is asked, however, section 6 is very important by the age of the bride. Because in Pakistan, according to framed laws, a girl less than 18 years old cannot be married. Section 7 to 12 the witnesses of the groom and bride are mentioned. Section 13 to 17 is about the Mehr of the bride.

Right To Divorce

Section 18 and 19 is very important for the bride. Because through these sections the right to divorce is granted to the bride. The right to divorce is the right of the bride which is granted by the groom with his consent. Usually, it is seen, these sections are crossed before the Nikkah Nama is brought to the bride for signature. It is a trick to mislead the bride.

 Dissolution of a Marriage

If a right to divorce is not granted to the bride, then she can not get divorced. But she can apply in the court for the dissolution. By the courts, a bride can be separated from his groom by the dissolution of the marriage contract. This Marriage Dissolution is also known as Khula in Urdu/Pakistan.

Monetary Allowance

The section is about the monthly allowance. The total income of the groom is mentioned at the time of Nikkah. This allowance is must be given to the bride by his husband. Even the section stipulates the husband to continue the monetary allowance to the groom after the end of the marriage contract.

Marital Status

Section 21 is about the marital status of the groom. He has to pronounce if he has been married previously. If yes then he has to produce the permission of the first wife to do second marriage.

Legal Witnesses

In section 25, the legal witnesses of the bride and groom, names, signatures, and dates are recorded.

سماء ڈیجیٹل سے بات کرتے ہوئے شرمین عبید چنائے کا کہنا تھا کہ آگاہی مہم ہماری خواتین کے بہت اہم ہیں کیونکہ ہمارے ملک بہت سے قوانین ہیں لکین ہمیں نہیں پتا کہ وہ ہمیں تحفظ دلا رہے ہیں یا نہیں اس ہی ضمن میں یہ ہماری ایک چھوٹی سی کاوش ہے اور خواتین کے حقوق کیلئے بہت کام کرنا ہے ۔
ویڈیو میں بتایا گیا ہے کہ نکاح نامے میں کل 25 شق شامل ہیں جس میں 1 سے 5 تک بنیادی معلومات ، 6 میں عمر، 7 سے 12 تک گواہوں کی تفصیل، 13سے 17 تک حق مہر سے متعلق معلومات، 18 سے 19 تک طلاق کے حقوق ، شق 20 میں ماہانہ خرچ ، 21 میں لڑکے کی ازدواجہ حیثیت اور 22 سے 25 میں دستخط لے جاتے ہیں ۔
شرمین نے مزید بتایا کہ جن افراد کی سوشل میڈیا تک رسائی نہیں ہے ان کے لیے ہمارا موبائل سنیما کام کررہا ہے جو دور دراز گاوں اور چھوٹے شہروں میں جاکر وہاں کے لوگوں بالخصوص ان کے حقوق کے بارے میں آگاہی دے رہا ہے۔
ویڈیو میں مختلف ہیلپ الئنز سے رابطے کی معلومات بھی شامل ہیں جس میں مشاورت کی خدمات، اور ان لوگوں کے لئے قانونی معاونت کی خدمات دستیاب ہیں جو اپنے نکاہ نامے کے بارے میں معلومات حاصل کرنا چاہتے ہیں ۔
